Legal Question in Criminal Law in Georgia
Criminal trespassing
My 18 year old daughter was out of college for the summer and was staying at my residence, we had a verbal confrontation after which I asked her to leave my home. In the process of me putting her things outside I broke her picture frame she called the police and they arrested me and I spent a night in jail for criminal trespassing and (6) counts of cruelty to children(they dropped these charges when I went to court the next day). How could they charge me with criminal trespassing when that was my home and I asked her to leave. Although I damaged the picture frame that to me would be criminal damage to property.
Was this a legitimate charge?

Re: Criminal trespassing
Criminal Trespass can be a proper charge if there is less than $500 in damage to the property. Which county is the case pending in, we may be able to help. Please call me at 404-250-1113.
