Legal Question in Criminal Law in Georgia
Can a DA file the Recidivist Act in a case after the individual has already been indicted on the same charges but prior to the trial date? This is a felony drug case, individual was indicted on 8 counts, then a week before the trial date was set the DA filed the Recidivist Act in the case, trying to sentence him under those rules.
