dad misses family
hello, on dec. 7 2006 i hit my wife during an argument, we exchanged several hits to one another and argued for several minutes. i went to work that day un-knowing that my wife had called the police and swore out an arrest warrant. upon returning home i was arrested and charged with domestic violence and cruelty to children. my 8 year old daughter over heard our argument, that is why the cruelty to children charge. she also served me with a temporary protective order while i was encarcerated. i have not been able to talk to or contact my wife since. my wife and i have issue`s that involves us only, i`m a great father to my children, and have never abused them. i go to court 01-04-07 for the probable cause hearing to learn if the restraining order will be continued for a lengthy period of time. my question is that althou my wife and i argue, and occasionally we strike one another( never to do harm, no heavy blows) what kind of evidence do i show up in court with to let the judge know that my kids are in no danger from me, nor my wife is in any danger. i love my family and i want them home. thank you.

Men do not hit women. Period. It's a crime and it's wrong. (Doing it in front of a child is all the more unforgivable). People who love someone do not hit them. Period.
Until you admit there is a problem, and undergo extensive anger management and counseling, it is very unlikely that a judge will want you back near your family, nor should you be allowed near them short term. Your post indicates that you do not yet understand how wrong your conduct is. I suggest you get a good lawyer, and a good counselor, and, if you can prove yourself over time, perhaps someday things will get better for you.
