Legal Question in Criminal Law in Georgia

Help in Emanuel County, GA Please.

Situation is this: father has physical but not 'legal' custody of minor children ages 14 and 15, both girls. 14yr old is 5 months pregnant, father is aware that a 26 yr old man is responsible. Father has moved said 26yr old into home to continue relationship with 14yr old daughter.

Mother now wishes to enforce the custody order to remove both children back to her care. Children do not wish to live with her.

What steps must they take to be placed where they wish?

One problem; small town, father's father is former county deputy, and nearly all law enforcement in this area has loyalty to this family. Mother fears that if she contacts authorities that father will take children and run.

Who else can she contact to aid her?

This situation was reported to CPS in that county. It is not known what, if anything, has been done or will be done.

Is the doctor that examined the 14yr old responsible for reporting her condition to CPS?

Please. Any help is appreciated.

The 26 year-old is a child molester and a statutory rapist. The father is arguably an accomplice, an accessory and a co-conspirator. Why in the world would anybody in their right mind want that girl to remain with the father? Could the mother possibly be that much worse? You didn't say where she wants to be, but unless it is with the mother, her wishes here are pretty much irrelevant. And with her demonstrated bad judgment, no judge will give much weight to her wishes. I am amazed at the mindset of this father. Most fathers would want to kill that man, not take him in. Unless the mother is a complete piece of trash, like the father sounds like he is, that is almost certainly where she belongs. Not sure on the doctor question, but I think he probably does have a duty to report it. Might want to check with a criminal lawyer on that one.
