Ex-wife forging my signature on tax return check
My wife and I divorced in June, 2003. According to the divorce agreement, any tax returns from tax year 2003 were to go to me to pay for previous taxes due. The tax refund check was sent to my ex-wife's address. She forged my signature on the check and deposited it. She then wrote me a personal check for the amount of previous taxes due, plus 50% of what was left over. Even though she paid me the money, isn't this still a federal offense? Can she be prosecuted? Would this hold up in court?

Can and will are two different words. Forgery is a violation of the law. Not every violation of the law will result in a prosecution. Not every violation of the law should be prosecuted. If it all ends up right in the end, my advice is let it go, at least in this particular circumstance.
