Polygraphs usually cannot be used in court. However, they may affect you being charged, and you should not consider one without having a lawyer.

In order for a polygraph to be used in court, the prosecution and defense must agree to use the results, prior to knowing what the results are going to be. Therefore, the only defense attorneys that I know that would agree to the use of a polygraph before they know the results are defense attorneys that have given the client a polygraph without the prosecution's knowledge So. the polygraph to be used in court becomes the second polygraph.

So, in answer to your question, if you fail the first polygraph, the prosecution will never know, so it cannot be used against you in court. As to the second, if you fail, it will defintely be used against you in court. Will it prove your guilty? I don't know because I dont' know anything about the details of the case. Good luck.

Lawrence
