Legal Question in Criminal Law in Georgia
Framed
Hi, Yesterday the police came to give issue a warrant for my older brother who I live with for a previous drug offense. My brother was not home at the time, and b/c my brother and I live in a ''hotel'' at the time they said they could just come in and look around. While looking around they found a baggie of marijuana in a cup on a clothes chest. The officer wrote me a ticket for possesion of marijuana(less than 1 oz.). I go to court on May 21. I have NEVER been arrested for anything before. What should I do?

Re: Framed
You should hire a lawyer to review the leag;lity of the search. The police officer may have been wrong about his right to search your hotel room.
Re: Framed
I do not think that the police can just come into the room unless they could see the pot from where they were standing. A motion to suppress all drugs found in the room must be filed at the time of arraignment, otherwise, you waive your ability to contest the entry into the room. Please call me at 404-250-1113 to discuss it.
