Legal Question in Criminal Law in Georgia

My friend filed a Habeas Corpus which has been accepted by the county where he is incarcerated. The GBI has furnished a letter that states his DNA is NOT present at the scene of the "crime". Two other DNA samples, unidentified, were found. Besides the obvious lack of due diligence by his attorney and the withholding of evidence by the D.A., this new revelation almost promises his case will be returned to the trial court. My questions: In Dekalb County, Ga. how can I find an attorney that handles such cases? What does my friend need to know, now???

First, the GBI letter does NOT read that your friend's DNA was not found. Because not every piece of DNA from the scene was recovered. Of the DNA recovered, none matches your friend, which is not the same thing you are writing. So, the obvious lack of due diligence is not so obvious to educated lawyers. Second, you never indicated what type of case your friend had originally. Was it a murder case, rape case, aggravated assault case, aggravated sexual battery case, burglary case, forgery case? No one has a clue what you are writing about. Third, does your friend that has been incarcerated for the last few years have money for an attorney? IF he does not then you don't need to find and bother attorneys you will not be retaining. Your friend needs to know exactly how much money he has to retain an attorney.

It is pretty straightforward - Metro Atlanta has many criminal and criminal appellate lawyers. They can determine the chances of winning on appeal - not friends.

Who is the "outside of Prison" representative for your friend?

Does your friend in prison have access to funds to pay for habeas fees plus costs?

We have been successful in a number of habeas cases and can speak to him/her this morning for a 1/2 hour free consult, no promises

Good luck
