Legal Question in Criminal Law in Georgia
My friend is in prison with life without parole.he was convicted of arm robbery in 1997. The crime was in 1995, in Appling,Ga. in Columbia County.The D.A. later gave him an indictment for a 2 strike serious violent felony-recidivist act that was passed in the state of Ga., in Jan of 1995.Has it now become unconstitutional for a person to receive 2 strikes your out because now it becomes retroactive to anyone who was given life without parole in a 2 strike recidivist act? Does he have grounds to petetion the courts for a new sentence under retroactive laws and policy.
