What would happen?

If a client, who has paid you nothing so far for your services, will not be able to pay your fee?

If a clientinsists on testifying, even though you believe that it is not in his/her best interest to do so?

If a client had paid me nothing then I would not have entered his case. For arguements sake, if I were involved in a non-paying case, I would immediately petition the court for a withdrawl from the case.

As far as the testifying, the client has a right to testify but I would put on the record that I advised the client against it and believe it to not be in his best interest. This way he could not claim "ineffective assistance of counsel" on appeal for that reason or act. However, unless I worked for the public defender's office, I would not be involved in a non-paying case. Don't know many who would!!
