Legal Question in Criminal Law in Georgia

Hello,

What kind of jail time is my daughter facing? My daughters situation is complicated. I will try to sum it up as best as I can. 19 yr old in metro Atlanta, Georgia facing 7 felony charges and 1 misdemeanor charge. The code sections are as follows: 42-5-15 16-13-26 (2), 16-8-5, 16-10-24 (3), and 16-7-1. She was arrested initially on May 1, 2011 for theft of services (non-payment for taxi services of $80), she was under the influence of alcohol and marijuana. She had obstruction of officer x 2 and interference W/ Government property as well as burglary (X boyfriend accusing her of taking his adderal medication, but both on the same medication at the time), this is why the charge for the NGCSA-ScheduleII (she had adderal tabs in her possession). She was in jail x 28 days than bailed out and taken to a rehab type facility for drug and depression/anger management treatment after being there for 95 days she walked away. Now back in jail with crossing guard line with drugs, VGCSA-Schedule II (7 Lortabs).

DA is offering 8 years serve 8 months remainder probation. Is that a good deal? She needs treatment.

No one here can possibly tell you if that is a good deal or a bad one. She possibly could spend decades in jail with that many charges. Whether the offer is good or not depends on which judge it is, which county it is, how strong the evidence is in each case, etc. The fact that you are asking here (for a second time) after everyone stressed before "SHE NEEDS A LAWYER" tells me that the one thing you could have done to help you have yet to do. When you face years or decades in prison, you don't talk directly to the prosecutor; you spend what it takes to get the best lawyer possible. As great as Law Guru is for some things, get off the computer and get her counsel. Good luck.
