Legal Question in Criminal Law in Georgia
Husband was charged with simple assault against me, there was no physical violence and no verbal threa of violence. We were arguing and he called the cops on me cause i threw my ring at him. Argument was about him drinking. Cops arrived and we had decided that i would stay and let him sleep it off. As the cops were leaving he knocked my bag off the counter and slammed the bedroom door they came back in and arrested him. He is bonded out and condition of bond is a no contact order. I went to the DA's office and requested that they drop the charges and the n contact order. They dismissed me and told me that they won't do that. They are running his background and he does have a prior arrest for kicking out a cop car window, which was downgraded from a felony destruction of govt property to a misdemeanor . He did probation and paid his fines. That was two years ago. There is no history of domestic violence or any other violence. How can they continue with this if i refuse to testify against him, i will testify for him. Why are they so concerned with his past?
