Legal Question in Criminal Law in Georgia
can self inflicted member disfigurement fall under aggravated battery?
1 Answer from Attorneys
As per Georgia law, "[a] person commits the offense of aggravated battery when he or she maliciously causes bodily harm TO ANOTHER by depriving him or her of a member of his or her body, by rendering a member of his or her body useless, or by seriously disfiguring his or her body or a member thereof."
If you are asking whether you a person could be convicted of aggrevated battery for a disfigure that person causes to him or herself, the answer appears to be no under a strict reading of the statute, as the statute requires the offense to be committed TO ANOTHER.
