Jail Time
My son was sentenced to four months in a state facility. He spent 5 weeks in a County jail, waiting on space and now is told he will not receive credit for the time spent in County jail. Is this legal?

To answer the question, I would have to examine the documents involved in his sentencing. For example, if his time in jail was pursuant to an arrest of probation warrant, it is probable that he would not receive credit for the time he was held because the arrest of probation order tolls, in many cases, the running of the underlying sentence.
