lawyer fails to appear

My husband retained an attorney last year for offences related to a single incident. The worst of which was obstructing a 911 call. Approximately 7 months later he received a great job offer in Texas and we made sure to advise the attorney and the bondsman that we were moving and would that be alright. They said no problem. A couple of months ago we received a letter in the mail to appear in court. The letter indicated that the appearance was less than a week away. It also indicated that our lawyer had been sent a copy of this. Because of the short notice my husband called the attorney, and this took several attempts without ever actually speaking directly to her. He was told my possibly a paralegal there that it would be taken care of and we would be informed of the outcome. We got another letter a few weeks ago stating that the offence stood unaccused at the time. We also received a statement from the lawyer showing that almost all of our retainer still remained untouched. Today a bailbondsman called my husband and said there is an arrest warrant out for my husband. We are completely upset and i wonder what the consequences are for the lawyer failing to appear.

First -- call the lawyer and advise that you are uspet that that she failed to appear, and need her to immediately rectify this situation, get the bond reinstated, and notify the bondsman. If that is unsuccessful, then retain a new lawyer and notify the old lawyer by certified mail. Your new lawyer may agree that the former atty needs to be reported to the Bar.
