Legal Question in Criminal Law in Georgia

Can this be done?

I know a man that was out on parole but something happened and they violated him. The charges are still pending on him but the state told his mother that they could not do anything about the pending charges until he services the rest of his time that he had on paper. We were thinking that he had go to court on these charges because this is what put him back in jail. People keep telling his mom that they are doing this because they don't have a case. She also told he that when she went to the courthouse that the lady hinted that the charges my be dropped. So my question is can they keep him there on those pending charges?

We will be more than happy to help, but your message is a bit unclear. In an attempt to answer your question, one can be held on a parole violation until a parole violation hearing is had. At that point, the original sentencing judge can impose more time if he wants. All that I just described has NOTHING to do with whether the new charges have been dealt with yet.
