getting my money back

i contracted a company to do my pool..paid him the money for new pool liner..the pool liner came in cause i called. this man nevr picked up the pool liner with the money i gave him all he told me day after day he will pick it up and be here in the morning..never showed up.called pool liner company up and told them to hold liner then hired someone else to get pool liner and install which had to pay all over again..called the man to give me my money back he told me when he has it.he has had it for almost 2 months now and since didnt pay for the liner for which i gave him the money for he should have my money i get all the excuses in the world.contract that we had ended and gave him time to pay me.what can i do to get my money back from him and bring him down.he told me i broke the contract by firing him so i am not entilted to my money back.what he failes to realize is that i didnt break the contract till after the old contract expired i fired him..it states if i break the contract before the time allowed for him to do the pool which was 3 weeks..the contract ened and got some one else 3 weeks after the contract had expired.

Generally, if one party breaches a provision of a contract, the other party is excused from his obligations. You didn't ask a specific question, so I would need to look at the contract to comment specifically on your situation.
