motion # to appeal due 2 Judges remarks at sent.
Looking for the rule/motion # to file an appeal in Federal Court-Georgia. At time of sentencing, the Judge sentenced my husband to an absurd amount of incarceration. He went on record saying that this is a prime example of how the system does not work etc.. He further stated that if he had any way out of the min. mandatory guide lines he would have used them. This was all before ''Blakley''. Is there a special motion code, (ie 3582C), in which to address this issue? Thank you for any and all help you may provide.

You probably don't want to hear this, but you really need an attorney. Simply filing a motion will not do the trick. An appeal is a very long and complicated set of documents and the process must be strictly complied with. You also need to contact a Georgia attorney. Good luck.
