Legal Question in Criminal Law in Georgia

My niece has been incarcerated for 2 weeks today on a violation of probation charge(non report and non payment). We have since paid all of her arrears but the probation officer refuses to talk with the family. The officer went to visit her in jail on 2/16/2011 and told her if she would sign a waiver he would send her to prison for 1 year. But she does not even have a year left on her probation. Her original charge was Tampering with Evidence. She has no new charge now. We have tried contacting the publc defender as well and no one will return our calls. The probation officer also informed her that if she went before the judge that her sentence would be worse. I dont understand how all this works but I do think this probation officer is trying to scare her. Would should we do as a family? Hire our on attorney? And can he sentence her to a year in prison? Would should we do?
