Legal Question in Criminal Law in Georgia
non-adjudicated sentence
I completed the terms of a non-adjudicated sentence six months ago. The case was dismissed. Can this record be exsponged in the state of Georgia? Sealed?
Thanks

Re: non-adjudicated sentence
There is no statutory procedure for expungement. It is addressed to the sound discretion of the Court and the inherent powers of a Superior Court Judge. Whether it would be granted or not, depends in very large measure with facts and circumstances not available in your question.
I have had a record expunged in cases where the client needed to obtain a top secret clearance, where the client wanted to serve a mission for his church, and where the client required licensure to perform his chosen profession.
I am assuming you are referring to a first offender plea. If that is true, you have no conviction record. It may be that what you are concerned with is the record of the arrest.
In any event, I recommend you discuss it with an attorney who has some experience in this area.
