Legal Question in Criminal Law in Georgia
nsf check
if a person were to write a check and said check did not clear w/sufficient funds, resulting into a warrant for an arrest. Does an officer have the right to tell their nieghbors ect... (when trying to locate this person), why they are looking for them? And do they have the right to go to the neighbors work to ask questions about the situation?

That is a really rotten thing for the Deputy to do. Unfortunately, I don't think it is technically improper on his part. There are some questions and possible defenses to your bad check charge though. Did you receive a notice from the payee demanding that you make good on the check? I guess you could look at the bright side....at least your neighbors won't be speculating that you had a warrant out on you for something worse! Please feel free to call me for additional help. Purchasing goods or services with a bad check is a crime if the person knew they didn't have sufficient funds in their account. Of course, to convict you, they are required to prove that you knew and it wasn't just an innocent error. Yes, the police can ask people about it and discuss what they are investigating. Your best bet is to quickly make good on the check, and tell the person you gave it to it was an honest mistake.
