Legal Question in Criminal Law in Georgia
First offense for small amt of marijuana
My son (21 yrs) was stopped for crossing over the white line on the outside of lane. They searched him and found a small amount of marijuana in his pocket. He had just let someone out of the car, my son saw the drugs in seat and put in glove box. When police started following him he put in pocket because he didn't want his younger brother involved. No drug test was given and the police told us they didn't believe him to be intoxicated but becuase of the drugs they processed him through the jail and realeased him to us that night with no bond. They (police) called us to pick up car and his brother (17) at the place that they pulled him over. He is scheduled for court March 1st he has never been arrested before. We have called courthouse to ask questions and they tell us we must wait to talk to solicitor on the day we have court. Should we take an attorney?
Money is a definite issue for my son and us. We do not know how much we are looking at on court date. Won't we have to pay it that day and what form of payment will we need to use? Gwinett/Walton County GA Thanks

Re: First offense for small amt of marijuana
Your chances of receiving a more favorable outcome increase when you have an attorney. Go to norml.org. Look at the left side where is says Find a Lawyer. Click on it and then click on GA. One of these attorneys should be able to help your son.

The charges that your son faces may subject him to mandatory jail, plus a fine. It would be unwise for him to fail to retain an attorney to represent him.
