If a passerby heard me and my wife arguing and heard me say if you call your brother i'll kill you is that a terroristic threat and can I be charged if they do not write a statement or appear in court

I will kill you is a threat. IF two people heard it (wife and passerby), then charges can be brought. Whether or not you will be convicted is a function of IF you have the balls to put a jury in the box, before learning that the witness will or will not appear in court. Lawrence is absolutely correct

Spousal immunity no longer applies to situations like this in Georgia

If you were joking and your wife agrees and/or if you feel witness will not show up for trial, do as Lawrence suggested, hire a great criminal trial attorney, like Lawrence, and put a jury in the box.
