The maximum penalty for a misdemeanor theft charge is $1,000.00 in fine, and 12 months in jail. What a person actually receives as a sentence depends on many factors. Prior record, circumstances surrounding the crime, among other considerations are usually considered by the Judge in setting the sentence.
