Possesion of a marijana contained substance outside a naval base

My boyfriend and I were sitting outside a naval base in June of 2006, when a narcotics pulled up next to us and asked to talk to us. He asked us separately if we had any thing illegal in the car. We both told him that we had a batch of marijuana brownies in the back seat. He then searched the car and found nothing else. We were brought in for questioning in an office on the base and they told us they had no way of testing the brownies and since they found nothing else there was nothing they could charge us with. Then we were pulled over by a police officer in the city we live in, in Alabama and they ran my boyfriends ID and said he had a felony warrant out for his arrest in Georgia. We never had any information about a warrant or anything of that matter sent to our address from the naval base. I contacted to naval base and the sheriff's office of the county and I believe he is being charged with possession of a dangerous substance. They issued the warrant in January. Why is he being charged with this offense almost 7 months later and what is the typical sentencing of this charge? Please get back to me I am very interested in finding a lawyer to represent his case.

The felony warrant would indicate that your boyfriend is being charged with possession of more than an ounce of marijuana for what was contained in the brownies. The statute of limitations on this felony is 4 years, so it is feasible that the charges were brought against him 7 months after the incident. During that 7 month period, the brownies were probably tested for marijuana. The length of sentencing depends mostly on his criminal history, and it can range from pre-trial diversion or drug court to 5-10 years.
