Possession of Marijuana (under 1 oz)

My 19 year old (college student) son, was arrested in Oct.'02 for possession of marijuana under 1 oz. (and 3 other misdemeaner charges) We paid for a consultation with an attorney and discussed all details. No court date as of yet.He was again arrested (poss. of marijuana under 1 oz.) in Dec. '02. The judge will be the same attorney that he had the consultation with. How do we handle this, as the court date (for the second arrest) is near?

I have recently represented some kids just like your son (in college, same age, etc.) for the same offense in cobb county and got a pretty good deal for them. i got the case nolle prossed (not prosecuted) and no fine if they served 24 hours of community service and passed a urine screen three times in a row. if i could get the same for your son, the cost would be cheap and there would be no conviction and not much to worry about. it complicates things a little now that it will not be his first offense but we could still probably work a good deal. your past lawyer now has a direct conflict and obviously cannot help you but he no doubt gave you some good advice that may still work since he is the judge. give me a call i will be happy to talk to you even if i don't represent you. my number is 404-325-4800. good luck.

We will be more than happy to help. The attorney who gave you a consultation who is now the judge is now in direct conflict and will NOT be the judge in your son's case. Since there have been two arrests, things are going to get more sticky. My first advice is to get your son to get some immediate clean drug screens and to enroll in a drug counseling program.
