Legal Question in Criminal Law in Georgia

Probation or Jail time?

My husband was arrested and found guilty by grand jury on 2-aggravated asaults, 1-simp battry, 1-reckless conduct, 1-terroristic threat, 1-discharging firearm close to highway. He does not have a criminal record, but he does have a very bad temper. He fired 4 shots into the ground while angry at two juveniles walking by. They were not armed only verbal confrontation. Will he be able to get probation and fines only or will jail time be a part of the sentence?

Re: Probation or Jail time?

He has not been found guilty by the grand jury ... only true billed. This simply means he has been formally charged and the grand jury found enough evidence to go forward with the prosecution.

Now, you other question can not be answered. It will depend upon his defenses available, the prosecutor's position and the judge's general court policy about this type of matter. It is possible but he may have to spend some time in a probation detention center. He most assuredly will have anger management counselling as a requirement.
