Legal Question in Criminal Law in Georgia

Probation Violation Time

This question is being typed for a friend.

He is currently held in jail... about 2 months ago, he was charged with a misdemeanor possession & pleaded guilty. He was already on probation for an old felony (and almost off, too). He got a risk reduction class and was assigned an additional (concurrently running propation). When they let him out, his first prob. officer violated his probation for him being put in (they said there was no violation put in for him when he went to court on that, and assigned him another probation officer already). Several times he called his probation officer, trying to schedule his next meeting (got blown off for a ''busy'' schedule) and his survellience officer did check in once. Then, a bit over a month later, his ID was run just on routine while he was out with some friends at a park (no new trouble, just by chance). It came up with the warrant from a probation violation, and they took him into jail. He's been in a month now, with no word from his probation officer, no word about court time, no word about anything. How long can they let him sit there and do nothing? Is there anything he can do to speed this along? General advice?

Re: Probation Violation Time

It is truly unfortunate that probationers are sometimes ignored after they have been taken into custody on an arrest of probation warrant. I am also very unclear from your discription, exactly what has transpired in this case. I am, however, very sure there is something to be done to both speed the process and determine if there is a quick way to resolve his current problem. He should have representation and someone who has dealt with revocations in the past. From your address, it appears we may be dealing with Cobb County, and I have appeared in Cobb County Courts for more than 30 years.

Please call if you want to discuss this case further.
