Legal Question in Criminal Law in Georgia
Once processed, can charges be dropped from the merchant?
Five 18 year old girls were arrested for shoplifting and charged with a misdemeanor and have hearing dates next month. The store owner now wants to drop the charges. In order to have their records espunged, do they need to appear for their court date and should they retain counsel? What type of punishment will they receive if the merchant wants to drop the charges?

Re: Once processed, can charges be dropped from the merchant?
They definitely need to appear at their court date since the prosecution has ultimate discretion over dismissing the charges. A misdemeanor carries a possible 12-month sentence. Depending on the jurisdiction, the girls may be able to enroll in a pre-trial diversion program if the prosecution refuses to flat out dismiss.
