Legal Question in Criminal Law in Georgia
I was pulled over in Monroe County, Georgia for weaving within my lane of travel and reckless driving. The officer, after seeing the notebook that I got my registration out of, got very excited when he seen a sleeve containing several social security cards that belonged to myself and my children and asked if he could search my van. I told him no. He was being a REAL jerk. He then asked me how many times I had ever been arrested and like an idiot, I lied and told him none. I honestly thought that him asking me that had nothing to do with what he was trying to do. The dispatcher called back and told him that I had indeed been arrested before (twice for misd. poss of marijuana one of which I am still on probation for in Alabama) He then placed me under arrest for lying to him. And proceeded to tear my van all to heck. Finding nothing. Is it a crime to lie to Law Enforcement about past criminal history? Is that just cause for an arrest? I was told that it had to be a lie about something material to what I was being investigated for. Thank you for your help.
