Legal Question in Criminal Law in Georgia
What does this mean?
Someone put a warrant out for my arrest just recently. When I was taken to jail the officer said that I went to a car lot, found a car that had been ''Repo'ed'' from me, and drove it into a gate and off the lot (which never happened because the car has never left my possession). When looking at the warrant it states ''--- commit offence of TRANS SUBJSEC INT(M) against ---, said offense being described as DID CONCEAL, REMOVE AND ENCUMBER A --- VEHICLE, PROPERTY SUBJECT TO A SECURITY INTEREST WITH --- WITH INTENT TO HINDER ENFORCEMENT OF THE SECURITY INTEREST.'' What does this mean? Why was I arrested for ''car theft as a misdemeanor''? What are my rights? And is there any way to prove that I was never read my rights when I was arrested?

Re: What does this mean?
It means you need to speak to an attorney. You have been charge with interfering with a security interest in a vehicle. The facts alleged would necessarily have resulted in damage to the vehicle. If there is no damage, it certainly places the allegations in the suspicious category.
If you have made all your payments, then certainly there could be no reason to enforce a security interest in the first instance.
I have no comment about the level of the charge, until I can review the warrant and get the full fact picture from you, should you wish to speak further about the charges.
