Legal Question in Criminal Law in Georgia

questioning in court

if a police officer is questioning a child that claims they've been molested and is trying to determine if the child can determine the truth from a lie by the color of the shirt he's and the child disagrees slightly (say the color was orange, but the child says red) and the child argues the color and the police officer says well that's fine i'm color blind anyway -- how's a professional to really determine if the child is lying if he can't determine if the answer she's giving him is true or not with the example he's trying to convince a jury?

Re: questioning in court

A witness's credibility is up to the jury to decide. It can certainly be argued by the defense that the child is not credible and therefore should not be believed; however, if a jury decides that the child is telling the truth, that is all that is needed under the law to sustain a child molestation conviction.
