Can you be rearrested
Ok here is the spew. My husband got charged with DUI drugs. When we went to court the judge said no prosicuition. The prosicuitor stated that she had no lab reports, video's, or audio's. now i know with the no prosicuition the state can come back and pick up the charges. can they rearrest you? If they have no evidence the first time to convict you what evidence would they need to charge you again? wouldnt that be double jeopardy?

I just noticed that your legal question pertains to Georgia law. You need to go back and post your question for an attorney in that state. Every state has different laws and different criminal procedures. By the way. The word is "prosecution."
