Legal Question in Criminal Law in Georgia

Received Writof Fieri Facias in the mail Friday with Order because we posted property bond on friend and according to the order he did not show up for court on November 12. He says he never got notice and neither did we as the surety. Now they are saying we owe the 11,000 plus court costs of $120. HELP!! Court date for March 18

It is really foolish to ever post bond for someone else. You're pledging your money to a criminal and criminals often fail to come to court.

You may lose the $11,000. Obtain a good lawyer. It may be expensive, but it may be cheaper than paying the $11,000.

In many cases, driving the defendant to jail, going off his bond, and turning him in, will help. If he has not already turned himself in, he doesn't care if you lose your money.

Assuming that your friend is telling you the truth, and intends to go to court when directed, you need to hire an attorney, who cah appear in court and ask the judge to lift the bench warrant adn reinstate the bond. THE ENTIRE PROBLEM IS A FUNCTION OF NOT HAVING AN ATTORNEY, who would have received notice of the court date and could have informed everyone. So many folks accused fo crime want to wait and see if they need an attorney. Well, in your case you were waiting for a bench warrant and bond forfeiture. Good luck.
