Legal Question in Criminal Law in Georgia
Requested a forty year old Felony record from Clerk of Court, Clerk cannot find record but refuses to respond or give affidavit to effect that the records are not to be found or available Its been 5 months since record was requested. Can clerk be liable for there actions ????

Liable for what actions?? They said they could not find it, and from your post they did respond. They don't work for you so you do not direct them to sign affidavits (for what purpose, you did not tell us). No, you have no lawsuit because the clerk is not doing what you want them to do. You might get helpful answers if you simply posted what your actual issue and problem are.
What actions? It seems they did respond by telling you they cannot find a record of it.
