Legal Question in Criminal Law in Georgia

Rights Possibly Violated

My relative is being charge with felony murder, aggrivated assault, armed robbery and wasn't even apart of the crime at all. H e has an arraingment but hasn't been arrested for the charge, hasn't had a preliminary hearing and the witnesses are telling the detectives that he was not there. What can I do to stop the arraingment? Are do I let him just plea guilty and later show how his rights were violated?

Re: Rights Possibly Violated

Someone should NEVER enter a guilty plea and then try to show that their rights were violated. If there is an arraignment scheduled, it means that your relative has already been indicted and the preliminary hearing must've been waived. You may be able to continue the arraignment in order to hire an attorney, but you can't stop it from happening. If there are witnesses to testify that your relative was not at the scene, the charges may be dismissed. It is very important that you hire an attorney.
