Legal Question in Criminal Law in Georgia

What is her sentence going to be?

My 14 year old daughter was detained by Macys & gwinnett county came & wrote a citation. She was caught with $44 worth of merchandise. What will the possible sentence be? We were told by gwinnett county sheriff that she could get jail time & possibly not be eligible for her drivers license until 19 or 20.

Re: What is her sentence going to be?

Shoplifting a value of $44 worth of goods is a misdemeanor that statutorily carries a sentence of up to 12 months. However, jail time is unlikely. If this is her first offense, she should be eligible for a pre-trial diversion program which would involve a shoplifting counseling class, community service, and a small fee, and would result in dismissal of the charges and expungement of the arrest from her record.
