Legal Question in Criminal Law in Georgia
I was sentenced under the First Offenders Act in 2008 for a assault charge 10years probation. In 2011 I was convicted of Vehicular Homicide and sentenced to 15 years in prison. December 2014 my Vehicular Homicide Indictment was dismissed and a new trial granted due to ineffective counsel and a defective Indictment. Now that I have been granted a new trial I am being accused of violating my probation Can they do this to me ? Isn't this guilty until proven innocent ?

Even if you are found not guilty of the charges you can still face a loss of your FOA status
Hire an attorney who has done this dual-criminal scenario before (VOP with new felony charge) like I have done.
