Simple battery/battery
If the accuser don't show up in court will the case be throw out.

I'm assuming this is a criminal case, in which case the crime is against the state and not the accuser. The accuser does not necessarily need to show up (or even want to prosecute you) for the prosecution to move forward. Practically speaking, whether the prosecution will move forward without the accuser depends on the strength of the state's case. Keep in mind the accuser only has to show up if called as a witness for trial, and not necessarily for all the court proceedings that you have been attending.
