Legal Question in Criminal Law in Georgia
My son was arrested in sept 2103 and pled guilty in oct 2013. arrest warrants were issued in another county in nov 2013. he was picked up by the state in dec 2013. In may 2014 he was brought to the county that had the warrants issued. He pled guilty in Feb 2015 and we back to prison in may 2015. Same case, same victim, same jurisdiction, same DA. Now he got his TPM and they aren't giving 8 months credit from the first sentence and not giving him credit from when he was brought back to face the other charges in the other county. they are giving him credit from Feb 2015 when he pled guilty to the second county. so what happened to 18 months of county jail and prison time before he pled guilty to the second warrants in the second county? and he never bailed out. he has been locked up since sept.2013 but his sentence never started until Feb 2015. How and Why? and he sentence is concurrent.

Since no one here has seen any of hiss entencing orders or attended his hearing,no one online can possibly answer how or why. One person, and only one, in the whole world, can answer, and that is his lawyer (with that many cases, unless he was completely foolish, he had one),so he can ask his attorney if he's not clear on it. Note that a person does not necessarily get credit for time in jail awaiting trial - a judge CAN include that in a sentence, but with different wording may start the sentence at the moment of a plea/conviction (he's still taken it into account, justworded it differently). What is really strange is you asking about his cases years after they happened;most people talk sentencing with their lawyer at the time of trial. In any event, a secondconcurrent sentence CAN'T start until the plea;it's not retroactive.
