Legal Question in Criminal Law in Georgia
If spouse was arrested for 2 aggraated assault, simple assault and cruelty to children in third degree in a, does the spouse and child have to testify? ive begged da to drop charges but not getting any where.

A spouse can now be forced to testify in family violence cases. As to children, a prosecutor can subpoena them and put them on the stand if they desire as well. It will be the prosecutor's decision to bring charges. Your husband needs and attorney asap. You should also seek legal advice if you or your children are subpoenaed, so that you know what you are required to do, and the consequences to you of your own actions in a case such as this.
