Legal Question in Criminal Law in Georgia
In the state of Georgia. If a felony charge has been signed off by a judge and dismissed, can that charge be reinstated? If so, how is it accomplished, how long does it take and who does it? My nephew was charged with felony charges back in November and was granted bond on all charges except one which was dismissed in December by one of the local judges. The charge was for felony stalking. He has been incarcerated since November and is having another bond hearing this Friday. His wife has been trying to have that charge reinstated, can that be done?

That depends on how it was dismissed. The attorney who represented your nephew should know.

Maybe. His lawyer needs to look at the paperwork involved in the dismissal.
