Legal Question in Criminal Law in Georgia

statute of limitations

I did a property bond for my cousin in 2000 and he was bound over from municipal court in Atlanta to State Court but they still cannot give us any informations as to a court date. The charge is public indecency. What is the statute of limitations for this?

Re: statute of limitations

The statute of limitations is not an issue in the case since it was bound over for prosecution. The issue now may be one of speedy trial. Your cousin's attorney should have filed a demand for speedy trial if the case has been arraigned, and your cousin asked him to do so. However, it is not frequently done because most defendants want the case delayed as long as possible if there is substantial risk of conviction.

He should speak to his attorney, and if he is not represented, he should get an attorney. If he would like to speak to me, please have him call.
