theft of mis-placed property

my daughter was arrested for ''theft of mis-layed property'', she found a bag layind by a bench at the mall she picked ot up and was going to take it to lost and found mean while the owner of the bag came back after remembering that it had been left behind at that time my daughter had the bag in her hands so the lady claimed my daughter had stolen it and the police came and arrested her. please tell me what type of charge is that, and what can be done? thank you!

Well it's a theft charge, which will probably be a misdemeanor. That means that the maximum possible punishment in one year confinement or $1000 fine. That being said, it sounds like there is a good defense in this case (she was taking it to lost and found).

Therefore a lawyer should be able to work out a favorable outcome.
