Legal Question in Criminal Law in Georgia
Theft by Shoplifting/Misdemeanor
I was charged with the above on 01/25/09 at Belk's in the Glynn Place Mall, Brunswick, GA. I was not read by rights nor did I give any statements to the police. I have two other charges for the same offense, one in 2007, and the other in 1988. Can you tell me what I might be facing as far as punishment and if this charge is possible to erase from my criminal background check as there are no other charges listed on my background check. Please advise.

this should be a misdemeanor if the amount alleged taken is less than $300 and this is a not a 4th tbs charge. Seek counsel asap to have the best chance to avoid jail time...a misdemeanor is punishable up to 12 months in jail and $1000 fine, a felony tbs charge is 1 to 10 years in prison...the range may vary and you need help now..
