If you are convicted of simple battery you face the standard misdemeanor sentence of up to $1,000 in fines and up to one year in prison.
However, there are some aggravating circumstances that could elevate your simple battery to a �misdemeanor or high and aggravated nature�, punishable by up to $5,000 in fines and up to one year in prison.

If the simple battery and FVB are charged in the alternative, then the accused is only facing a maximum of 12 months in jail. If the accused has no prior convictions, and the victim is NOT injured, then the sentence may be probation. The goal should be to hire an attorney that can defend him and speak for him
