ummm
where i live we've had a few break ins i was wondering if it is legal to kill the intruder if they are caught in the act

That's a tough question. The best answer I can give you is that you have a right to protect yourself, especially when in your own home.
If, however, the person poses no threat, you know it, and you still shoot to kill, you could possibly get charged with murder. Like if you come down the stairs and they are running away and you shoot them down, it might be murder.
