Underage possession - alcohol
my son was arrested at athen clarke county for underage possession - alcohol while in town. they are charging him with this but did not do any tests to determine if he had any alcohol nor did he have any alcohol in his possession at that time. They are stating that they can arrest you just by alcohol odor from an office and that a test is not required for this. is this true? can they bring a case against you without having evidence that you had alcohol? we don't have the money for an attorney fee so any help would be appreciated. we spoke with the solicatar from athens and she stated again that the officers could arrest you just by smelling alcohol but again nothing was done, no field tests nor blood tests or field tests were done. what are our options?

YOur option is to get a lawyer. If you are indigent, the court will appoint counsel on request.
