Legal Question in Criminal Law in Georgia
If no warrent was issued and the person in prison. is this legal. and is he or she entitle to a retril where a warrent would be issued.

No warrant is required IF the grand jury returned a direct indictment. Here is the reality: the person is in prison. He either had a jury trial, which means evidence was presented, or he entered a guilty plea, which means he knows he did it. Now, you are asking about a warrant for an arrest for the case for which he is serving a prison term. You are silly.
