Legal Question in Criminal Law in Georgia

Can my wife forge my signature on a tax return check without my consent? We were still legally married but had been seperated for months and had signed divorce papers already. I never consented to her signing my name. I never even knew about this check! I found out this past November about this when I requested copies of my tax returns for a mortgage I was trying to get. I want to know how she was able to deposit this with out me into an account without my name on it. Is the bank responsible for accepting my forged signature?

Start out by talking with your attorney in your divorce.

If the matter is not resolved in divorce court by your lawyer, you may need to make a police report, swear out a warrant for her arrest, and make a written claim with the IRS.

Why would the bank be responsible for accepting your forged signature? The bank is not a guarantor of your signed documents.

Here is the real question: Do you have children with yoru ex-wife? Because you can prosecute her for first degree forgery in Georgia. After she is arrested, and her life and your children's lives are turned upside down for $ 1200, then you will write and ask about how a prosecutor or judge can do such and such when you put the entire thing in motion.
